12. GOVERNING LAW AND DISPUTE RESOLUTION
  • This Agreement shall be governed by and construed in accordance with the laws of India In the event of any dispute or difference arising between the “User” and the “Website, App Developer/App Moderator” in regard to any matter relating to or connected with the Application “Docsvalley” the aggrieved party shall call upon the other party for a mutual discussion to redress the grievances or to explore the possibility of amicable settlement by giving 30 days written notice. In the event if either party fails to respond to such a notice for amicable settlement or if the parties cannot arrive at a mutually acceptable settlement, then the dispute between the parties shall be referred to the mutually agreed Arbitrator to be appointed by both the Parties, as per the provisions of the Arbitration & Conciliation Act 1996 and the amendment. The seat of arbitration shall be at Bangalore which is going to be final and binding for both the parties and Court in Bangalore alone shall have jurisdiction in regard to this Agreement.
13. LIMITATION OF LIABILITY AND INDEMNIFICATION
  • Your use of the website and App or any content available thereof is entirely at Your own risk and We shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, monetary or any other damages, fees, fines, penalties or liabilities whatsoever arising out of or relating to Your use of the website and App.
  • This website and App is meant to solely serve the Indian audience/customers residing in India and does not intend to serve outside the jurisdiction of India. The liability of the developers shall be limited to the legal jurisdiction within India. You may terminate Your access to the Website and App if You are not satisfied with the Website and App.
  • You shall defend, indemnify and hold Docsvalley, and its officers, directors, employees, representatives and agents harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including without limitation, reasonable legal fee that may result from or alleged to result from (a) Your use of the Website and App; or (b) Your breach of any rules, regulations and/or orders under any applicable law.
  • You are also responsible for any breach of Your obligations under the Agreement and/or for the consequences of any such breach.
